Navesink Wellness Center (“NWC”) owns and operates this www.navesinkwellness.com website business. All references to “we”, “us”, “our”, this “website” or this “site” shall be construed to mean NWC.

HOW WE MODIFY THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time by posting an amended Privacy Policy that is always accessible by clicking on the “Privacy Policy” link at the bottom of every page of this site. The “Last Updated” date above shows when this Privacy Policy was last changed. Your continued use of this site after an update indicates your acceptance of the amended Privacy Policy.

Regarding Personal Information (defined below), if any modifications are materially less restrictive on our use or disclosure of the Personal Information previously disclosed by you, we will obtain your consent before implementing such revisions with respect to such information.

HEALTH INFORMATION AND YOUR CARE

This Privacy Policy describes how we handle information collected through this website. If you become a client, the health information we create and maintain in connection with your care is protected by the Health Insurance Portability and Accountability Act (HIPAA) and other applicable laws, and is described in our Notice of Privacy Practices, which we provide to clients.

Please do not include detailed health or clinical information in website forms, emails, or other messages sent through this site. Use them to reach us, and we will discuss the details with you privately. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline) or call 911.

THE TYPES OF INFORMATION WE COLLECT

Personal Information. “Personal Information” includes any information regarding a natural person that may be used, directly or indirectly, to identify the person. Personal Information that we collect may vary with each separate purpose for which you provide it, and it may include one or more of the following categories: name, physical address, email address, phone number, information you choose to include in a form or message (such as the reason you are contacting us), appointment details, account login information, payment information (including credit card number, expiration date, and billing address), and approximate location data.

Usage Data. We collect information about your use of this site automatically, either directly or through the third party tools described below. It may include: your IP address, device and browser type, operating system, country and approximate location, the website or advertisement that referred you, the pages you visit and the order in which you visit them, the time spent on each page, the links and buttons you click, and, for tools that record sessions, your clicks, taps, scrolling, and mouse movements (“Usage Data”). Some Usage Data is collected only with your consent, as described under “Cookies and Similar Technologies.” Usage Data may be used, alone or combined with other information, to identify a person, and we treat it accordingly.

Call and Form Tracking Data. If you have allowed Marketing tools, our call tracking provider may display a tracking phone number on this site that forwards to our office. When you call that number or submit a form, the provider records information such as the phone number you call from, the date, time, and length of the call, the page and advertising source that led to your call or submission, and the information you enter in the form.

HOW AND WHEN WE COLLECT INFORMATION

Personal Information. We collect Personal Information when you provide it to us, for example when you complete a contact or consultation request form, book an appointment through our scheduling tool, sign up for our newsletter, or create or log in to an account on this site.

Your Communications with Us. We collect Personal Information that you provide when you communicate with us, for example by email, phone, or text message.

Usage Data. As you navigate this site, Usage Data may be passively collected (that is, gathered without your actively providing the information) using cookies, pixels, scripts, and similar technologies, as described below.

HOW WE USE YOUR INFORMATION

We may use your Personal Information to respond to your inquiries, schedule consultations and appointments, provide the services or complete the transactions for which it was given, send you our newsletter or other communications you have requested (you may unsubscribe at any time), and for our private, internal reporting and the security of this site.

We may use Usage Data to operate and secure this site, remember your preferences, understand how visitors use this site, fix problems, and improve our content and services. If you allow Marketing tools, we also use Usage Data and Call and Form Tracking Data to measure and improve the effectiveness of our advertising.

INFORMATION SHARING AND DISCLOSURE

General Disclosure Policy. We do not sell your Personal Information for money. We disclose Personal Information and Usage Data only as described in this Privacy Policy.

Affiliated Entities. We reserve the right to provide your Personal Information and Usage Data to any affiliated entities we may have, including our subsidiaries. Affiliated entities are entities that we legally control (by voting rights) or that control us.

Service Providers. We provide access to Personal Information and Usage Data to trusted service providers that help us operate this site and our practice, such as website hosting (Webflow), member accounts (Memberstack), appointment scheduling (Calendly), payment processing, email, and security providers. Our service providers are given access to your information only as reasonably necessary to provide the services for which they are engaged.

Analytics and Advertising Providers. With your consent, the analytics and advertising providers listed under “Cookies and Similar Technologies” receive Usage Data and, where described, Call and Form Tracking Data. These providers may use this information as described in their own privacy policies. Under some state privacy laws, sharing information with advertising providers may be considered “sharing” or “targeted advertising.” These tools stay off unless you turn them on, and you can turn them off at any time.

Successors. If we sell or otherwise transfer part or all of our business or assets to another organization, such as in the course of an acquisition, merger, bankruptcy or liquidation, we may transfer your Personal Information and Usage Data. In such an event, we will require the buyer or transferee to agree to our commitments provided in this Privacy Policy.

Legal Process, Enforcement and Security Notice. We reserve the right to disclose your Personal Information and Usage Data if we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary (i) to satisfy any applicable law, regulation, legal process or enforceable governmental request (such as for example, to comply with a subpoena or court order), (ii) to detect, prevent, and address fraud or other illegal activity, and (iii) to investigate, respond to, or enforce violations of our rights or the security of this site.

Your California Privacy Rights. Under California Civil Code Section 1798.83 (“Shine the Light”), California residents have the right to receive, once a year, information about third parties with whom we have shared information about you or your family for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared. To make such a request, please send an email to the email address provided in our contact information below and include the phrase “California Privacy Request” in the subject line, the domain name of the website you are inquiring about, along with your name, address and email address. We will respond to you within thirty days of receiving such a request.

COOKIES AND SIMILAR TECHNOLOGIES

“Cookies” are small pieces of information stored by your browser on your device. “Pixels” and scripts are small pieces of code that send information to us or to a third party provider when a page loads or when you take an action. We group these technologies into three categories.

Essential (always on). These are needed for this site to work and cannot be turned off through our consent tools. They keep the site, forms, member login, and appointment booking working, and they remember your consent choices. They include tools provided by Webflow, Memberstack, and Calendly. Visit the Webflow Privacy Policy at https://webflow.com/legal/privacy and the Calendly Privacy Notice at https://calendly.com/legal/privacy-notice

Website Performance (only with your consent). These help us understand how the site is used so we can improve it.

Google Analytics (Google) – Measures site traffic and how visitors use our pages. Visit the Google Privacy Policy at https://policies.google.com/privacy. You may opt out of Google Analytics with Google’s Browser Add-on, available at https://tools.google.com/dlpage/gaoptout/

Microsoft Clarity (Microsoft) and Hotjar – Record how visitors interact with our pages, including clicks, taps, scrolling, and mouse movements, to create session replays and heatmaps. Visit the Microsoft Privacy Statement at https://www.microsoft.com/privacy/privacystatement and the Hotjar Privacy Policy at https://www.hotjar.com/legal/policies/privacy/

Webflow Analyze (Webflow) – Measures page visits and how visitors move through the site. Visit the Webflow Privacy Policy at https://webflow.com/legal/privacy

Marketing (only with your consent). These help us understand how our advertising and outreach are working.

Google Ads (Google) – Measures when people who clicked our ads go on to contact us. This may include “enhanced conversions,” which sends Google a hashed (scrambled) version of the email address or phone number you enter in a form so that Google can match your inquiry to an ad click. Visit the Google Privacy Policy at https://policies.google.com/privacy

Meta Pixel (Facebook/Instagram) – Tells Meta which pages you visit and actions you take on this site, such as submitting a form, so we can measure and improve our ads on Meta’s platforms. Visit the Meta Privacy Policy at https://www.facebook.com/privacy/policy/

WhatConverts – Provides the call and form tracking described above. Visit the WhatConverts Privacy Policy at https://www.whatconverts.com/privacy-policy

Google Tag Manager, which we use to load some of these tools, is itself only loaded with your consent.

Your Choices. Optional tools stay off until you turn them on. When you first visit, a banner lets you accept them or choose which categories to allow. You can change your choice at any time using the “Manage Consent” link at the bottom of every page. If you have turned all optional tools off, we may ask again on a later visit. Turning a category off stops those tools from collecting information going forward; it does not delete information collected before you changed your choice.

When you allow a category, you consent to us and the providers listed for that category collecting and receiving the information described above, including information about your interactions with this site, for the purposes described in this Privacy Policy.

You can also block or delete cookies through your browser settings. Please remember, however, that some features of this site may not work without essential cookies.

Web Beacons – sometimes called single-pixel gifs or clear gifs – may be included in promotional email messages or other communications in order to determine whether messages have been opened and acted upon.

SOCIAL MEDIA INTERACTIONS

This site may include links to our pages on social media platforms such as Facebook and Instagram. If you choose to interact with these platforms, you may share certain profile elements, including your comments. This sharing is subject to each social media program’s privacy policies.

DO NOT TRACK AND GLOBAL PRIVACY CONTROL

Some Web browsers incorporate a “Do Not Track” feature that signals to websites that you visit that you do not want to have your online activity tracked. Because there is no common standard for how websites should respond to these signals, we do not respond to “Do Not Track” signals at this time.

We do recognize the Global Privacy Control (“GPC”) signal. If your browser sends it, we turn off ad personalization in our Google advertising tools. Regardless of these signals, our Marketing tools remain off unless you turn them on.

YOUR PRIVACY CHOICES AND RIGHTS

Upon request, we will permit you to access, correct, or update your Personal Information, or to ask us to delete it, subject to our legal and professional record-keeping obligations. Depending on where you live (for example, New Jersey or California), you may have additional rights, such as the right to opt out of targeted advertising or the sale of your personal information, and the right to appeal our decision on your request.

To make a request, email us at the address below with “Privacy Request” in the subject line. We request identification prior to approving such requests, and an authorized agent may submit a request on your behalf where permitted by law. We will respond as required by applicable law, and we will not discriminate against you for exercising your rights. We reserve the right to decline any requests that are unreasonably repetitive or systematic, require unreasonable time or effort of our technical or administrative personnel, or undermine the privacy rights of others, to the extent permitted by law. If you have an account on this site, you may also update certain information yourself.

To stop receiving our newsletter or promotional emails, use the unsubscribe link in any such email.

DATA RETENTION

We keep Personal Information for as long as needed for the purposes described in this Privacy Policy, including to provide our services and to meet our legal, accounting, and professional record-keeping obligations, and then delete it or make it unidentifiable. Information collected by third party analytics and advertising providers is retained according to their own policies.

DATA SECURITY

We will implement reasonable and appropriate security procedures consistent with prevailing industry standards to protect data from unauthorized access by physical and electronic intrusion. Unfortunately, no data transmission over the Internet or method of data storage can be guaranteed 100% secure. Therefore, while we strive to protect your Personal Information by following generally accepted industry standards, we cannot ensure or warrant the absolute security of any information you transmit to us or archive at this site.

Information you submit through this site is encrypted in transit using industry-standard encryption (HTTPS/TLS).

ONWARD TRANSFER OUTSIDE YOUR COUNTRY OF RESIDENCE

Any Personal Information which we may collect on this site may be stored and processed in our servers located in the United States or in any other country in which we, or our affiliates, subsidiaries, agents, or service providers maintain facilities. By using this site, you consent to any such transfer of Personal Information outside your country of residence to any such location.

LINKS TO JOINT VENTURE MARKETING PARTNER SITES

This site may contain links to other websites operated by our joint venture marketing partners. If you do click on any of the links to their websites or accept any of their promotional offers, your click-through information and any information that you provide in the process of registration or purchase will be transferred to these sites. We have no responsibility or liability for the policies and practices of these sites. You should be careful to review any privacy policies posted on any of these sites before providing information to them.

CHILDREN’S ONLINE POLICY

We are committed to preserving online privacy for all of our website visitors, including children. This site is a general audience site intended for adults, including parents and guardians seeking services for their children. Consistent with the Children’s Online Privacy Protection Act (COPPA), we will not knowingly collect any information from, or sell to, children under the age of 13. If you are a parent or guardian who has discovered that your child under the age of 13 has submitted his or her personally identifiable information without your permission or consent, we will remove the information from our active list, at your request. To request the removal of your child’s information, please contact us as provided below under “Contact Us”.
